These Terms of Service ("Terms") govern your access to and use of Sentimento's Telegram community management bot and related services (the "Service"). By using the Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By adding Sentimento to your Telegram group, accessing our dashboard, or otherwise using our Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

If you do not agree to these Terms, you must not use the Service.

If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

2. Service Description

Sentimento is a Telegram bot that provides:

Automated Moderation: Anti-spam, link filtering, word blacklists, phishing protection, and raid defense
Member Verification: CAPTCHA challenges for new group members
Automated Messaging: Welcome messages, auto-responses, scheduled messages, and recurring announcements
Analytics Dashboard: Community insights, activity metrics, and reporting
AI-Powered Features: Sentiment analysis, topic detection, and natural language chat (PRO tier)

The specific features available to you depend on your subscription tier (FREE, LITE, or PRO).

3. User Responsibilities

3.1 Account and Access

You must have a valid Telegram account to use the Service
You are responsible for all activities that occur under your account
You must maintain the security of your Telegram account
You must be at least 13 years old to use the Service

3.2 Group Administration

If you add Sentimento to a Telegram group:

You must be an administrator of that group
You are responsible for configuring the bot appropriately
You must ensure the bot's use complies with Telegram's Terms of Service
You are responsible for informing group members about the bot's presence and data collection

3.3 Compliance with Laws

You agree to use the Service in compliance with all applicable local, state, national, and international laws and regulations.

4. Prohibited Uses

You agree NOT to use the Service to:

4.1 Illegal Activities

Facilitate any illegal activities
Distribute illegal content
Evade legal obligations

4.2 Harmful Content

Spread malware, viruses, or malicious code
Conduct phishing or scam operations
Distribute spam or unsolicited messages
Harass, threaten, or abuse others

4.3 Rights Violations

Infringe on intellectual property rights
Violate the privacy of others
Impersonate other individuals or entities
Collect personal data without consent

4.4 Service Abuse

Attempt to gain unauthorized access to the Service
Reverse engineer, decompile, or disassemble the Service
Circumvent usage limits or restrictions
Interfere with or disrupt the Service
Use automated systems to abuse the Service
Resell or redistribute access to the Service without authorization

4.5 Platform Violations

Violate Telegram's Terms of Service
Use the Service in ways that could get groups or users banned from Telegram

5. Payment Terms

5.1 Subscription Tiers

FREE: No payment required; limited features and data retention
LITE: $9.99–$29.99 per month (based on group size)
PRO: $69.99 per month

5.2 Billing

Subscriptions are billed monthly in advance
Payment is processed securely through Stripe
Prices are in US Dollars (USD) unless otherwise stated
All fees are non-refundable except as required by law

5.3 Payment Methods

We accept major credit cards and debit cards via Stripe
You authorize us to charge your payment method on a recurring basis

5.4 Price Changes

We may change subscription prices with 30 days' notice
Price changes take effect at the start of your next billing cycle
Continued use after price changes constitutes acceptance

5.5 Failed Payments

If payment fails, we will attempt to charge your payment method again
After multiple failed attempts, your subscription may be downgraded to FREE
You are responsible for ensuring your payment information is current

5.6 Cancellation

You may cancel your subscription at any time
Cancellation takes effect at the end of your current billing period
No partial refunds for unused portions of a billing period
Upon cancellation, your account will revert to FREE tier

6. Intellectual Property

6.1 Our Rights

The Service, including its code, design, features, documentation, and branding, is owned by Sentimento and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our permission.

6.2 Your Content

You retain ownership of content you submit through the Service (e.g., custom messages, configurations). By using the Service, you grant us a license to process this content as necessary to provide the Service.

6.3 Feedback

If you provide feedback or suggestions about the Service, we may use them without obligation to you.

7. Termination

7.1 Termination by You

You may stop using the Service at any time by removing Sentimento from your groups and canceling any paid subscriptions.

7.2 Termination by Us

We may suspend or terminate your access to the Service:

If you violate these Terms
If you engage in prohibited uses
If required by law
For any reason with reasonable notice

7.3 Effect of Termination

Upon termination:

Your right to use the Service ends immediately
Your data will be deleted according to our Privacy Policy
Any outstanding payment obligations remain due
Provisions that by their nature should survive termination will survive

8. Disclaimers

8.1 Service Provided "As Is"

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

8.2 No Guarantee of Availability

We do not guarantee that the Service will be uninterrupted, timely, secure, or error-free. We may modify, suspend, or discontinue the Service at any time.

8.3 Third-Party Services

The Service integrates with third-party services (Telegram, OpenAI, Stripe). We are not responsible for the availability, accuracy, or practices of these services.

8.4 Moderation Accuracy

While we strive for accurate moderation, we do not guarantee that all spam, harmful content, or violations will be detected or that legitimate content will never be incorrectly flagged.

9. Limitation of Liability

9.1 Exclusion of Damages

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL SENTIMENTO BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

9.2 Cap on Liability

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $100 USD, WHICHEVER IS GREATER.

9.3 Basis of the Bargain

THE LIMITATIONS IN THIS SECTION APPLY REGARDLESS OF THE THEORY OF LIABILITY AND EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THESE LIMITATIONS ARE AN ESSENTIAL BASIS OF THE AGREEMENT BETWEEN YOU AND US.

10. Indemnification

You agree to indemnify, defend, and hold harmless Sentimento and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising from:

Your use of the Service
Your violation of these Terms
Your violation of any third-party rights
Content you submit through the Service

11. Dispute Resolution

11.1 Informal Resolution

Before filing any formal dispute, you agree to contact us and attempt to resolve the matter informally for at least 30 days.

11.2 Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.

11.3 Jurisdiction

You agree to submit to the personal jurisdiction of courts for the resolution of any disputes.

12. General Provisions

12.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Sentimento regarding the Service.

12.2 Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect.

12.3 Waiver

Our failure to enforce any right or provision of these Terms will not constitute a waiver of that right or provision.

12.4 Assignment

You may not assign your rights under these Terms without our consent. We may assign our rights without restriction.

12.5 Modifications

We may modify these Terms at any time. Material changes will be communicated through the Service or via Telegram. Continued use after changes constitutes acceptance.
